Under the terms of Hannah’s US divorce settlement, she was entitled to 40% of her ex-husband’s UK defined contribution pension. Hannah contacted Florin Pensions as she did not know how to actually implement the divorce settlement in the UK.
We explained that a US settlement has no legal standing in the UK, so her ex-husband’s UK pension provider would require her to engage UK legal counsel to obtain a UK court order confirming the terms of any pension split (commonly a UK pension sharing order). Florin Pensions assisted Hannah with the appointment of UK legal counsel and liaised with her ex-husband’s UK pension provider during the court order process. We also advised Hannah on the set-up of her new UK personal pension to receive her 40% share, in addition to her ongoing UK pension investment strategy.
